Terms of Service

These Terms of Service supplement the Public Offer Agreement and the Privacy Policy. In case of conflict between documents, the Public Offer Agreement takes precedence.

Definitions

• Service — the cloud SaaS platform 4u.bot (hereinafter — "Service Provider"), available at app.4u.bot.
• User — an individual or legal entity who has registered on the Service and uses it to create and manage Telegram bots.
• Bot — a Telegram bot created and configured by the User through the Service.
• Subscriber — an end user on Telegram who interacts with the User's Bot.
• Content — any texts, images, files, bot configurations, knowledge bases, and other materials uploaded or created by the User in the Service.

Account registration

• To use the Service, you must create an account by providing accurate information (email, name).
• You may register via email/password, Google OAuth, or Facebook Login.
• You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorized access to your account.
• One account is intended for use by one organization. You may invite other team members with appropriate roles and permissions.
• You must be at least 18 years old or have authorization from a legal guardian to use the Service.

Subscription plans and billing

The Service offers the following subscription plans:

• Current prices and plan limits are published on the Subscription page.
• Paid subscriptions are billed on a prepayment basis. Subscriptions renew automatically at the start of each billing period until you cancel.
• Payments are processed via monobank, LiqPay, or WayForPay. The Service Provider does not store your bank card details.
• Cancellation: You may cancel your subscription at any time from your account dashboard. After cancellation, access continues until the end of the current paid period.
• Refunds: Refunds for unused periods are not provided, in accordance with the Law of Ukraine "On Electronic Commerce." Exceptions may be considered on a case-by-case basis.
• The Service Provider reserves the right to change prices with 30 days' prior notice. Changes do not affect the current paid period.

Acceptable use

By using the Service, you agree not to:

• Send spam or unsolicited bulk messages through your bots
• Create bots for fraud, phishing, or deceiving users
• Distribute illegal content, including material that infringes copyrights
• Collect subscriber personal data without their consent or lawful basis
• Use the Service in violation of Telegram rules or the Telegram Bot API terms
• Attempt to gain unauthorized access to the Service, other accounts, or server infrastructure
• Resell or transfer access to the Service to third parties without permission
• Deliberately overload the Service with excessive requests or malicious activity
• Use the Service to distribute malware, viruses, or other malicious code

Violations of these rules may result in a warning, temporary feature restriction, or account suspension without refund. We reserve the right to determine whether specific usage violates these Terms, at our sole discretion.

User content

• You retain all intellectual property rights to the Content you create or upload to the Service.
• By uploading Content, you grant us a limited license to store, process, and transmit it solely for the purpose of providing the Services (e.g., displaying bot messages, processing AI queries).
• You bear full responsibility for Content distributed through your bots. This includes compliance with copyright laws, advertising regulations, and consumer protection rules.
• We do not pre-review User Content, but we may remove or restrict access to Content that violates these Terms or applicable law.

Bot subscriber responsibility

You are the data controller with respect to your bot subscribers' personal data. 4u.bot acts solely as a data processor.

You are required to:

• Have a lawful basis for collecting and processing subscriber data (consent, contract, etc.)
• Inform subscribers about how their data is collected and processed
• Provide subscribers with the ability to unsubscribe or delete their data
• Comply with the Ukrainian Law "On Protection of Personal Data" and, where applicable, GDPR

Subscriber data is stored in isolated database schemas and is accessible only to you. For more details on data processing, see our Privacy Policy and Section 13 of the Public Offer Agreement.

Payment processing

Subscription payments are processed by third-party payment providers: monobank, LiqPay, and WayForPay. 4u.bot is not a payment system and does not store bank card data.

If you use the feature to accept payments from your bot subscribers (paid groups, subscriptions, orders), you are responsible for:

• Compliance with e-commerce and consumer protection legislation
• Providing subscribers with information about the seller, prices, and return policies
• Proper fiscal registration of transactions (where required)

4u.bot is not a party to the financial relationship between you and your bot subscribers.

AI features

• The Service uses artificial intelligence technologies (OpenAI, Anthropic) for content generation, AI chats, the bot builder assistant, and the knowledge base (RAG).
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. AI outputs may contain errors or inaccuracies.
• You are responsible for reviewing and approving any AI-generated content before publishing or distributing it through your bots.
• Data sent to AI providers is processed according to their respective privacy policies. We do not recommend sending confidential or sensitive information through AI features.

Intellectual property

• Platform. The 4u.bot Service, including its code, design, interface, trademarks, and documentation, is the intellectual property of the Service Provider. Your subscription grants you the right to use the Service but does not transfer ownership rights.
• Your content. You retain all rights to your bot content, including texts, images, knowledge bases, and configurations.
• Bots. The configuration, logic, and content of your bots belong to you. You may export your bot data at any time.

Data and privacy

• The collection, processing, and storage of personal data are governed by our Privacy Policy, which is an integral part of these Terms.
• We process data in accordance with the Ukrainian Law "On Protection of Personal Data" (No. 2297-VI) and, where applicable, EU Regulation 2016/679 (GDPR).
• Each User's data is isolated at the database level (schema-per-tenant). Other Users do not have access to your data.

Limitation of liability

The Service is provided on an "as is" basis. We make reasonable efforts to ensure stable operation but do not guarantee uninterrupted service.

The Service Provider is not liable for:

• Losses caused by third-party services (Telegram, payment systems, AI providers)
• Loss of revenue or profit related to the use or inability to use the Service
• Content created and distributed by Users through the Service
• Results produced by AI features (content generation, chatbot responses)
• Actions or inaction of the User's bot subscribers

The Service Provider's maximum liability is limited to the amount paid by the User for the last 3 months of Service usage. Nothing in these Terms limits liability for intentional misconduct or gross negligence, or in cases where limitation of liability is prohibited by applicable law.

Service availability

• We aim to provide 24/7 Service availability but do not offer formal Service Level Agreements (SLA) for the free plan.
• For paid plans, we target 99.5% monthly uptime as specified in the Public Offer Agreement.
• We may conduct scheduled maintenance with prior notice. We endeavor to perform such work during periods of minimal load.
• We are not responsible for outages caused by force majeure, actions of third parties, or factors beyond our control.

Termination

• Cancellation by User: You may cancel your subscription and delete your account at any time through your account dashboard or by contacting [email protected].
• Suspension by Service Provider: We may suspend or terminate your account for violation of these Terms, with 7 days' prior notice (except in cases of serious violations, where suspension may be immediate).
• Data deletion: After account deletion, your data is retained for 30 days for recovery purposes, after which it is permanently deleted. Payment records are retained for 3 years in accordance with tax legislation.
• You may request an export of your data before deleting your account by contacting support.

Modifications to Terms

• We reserve the right to modify these Terms of Service.
• We will notify you of material changes via email or in-Service notification at least 14 days before they take effect.
• Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
• If you do not agree with the changes, you have the right to stop using the Service and delete your account.

Governing law

• These Terms of Service are governed by and construed in accordance with the laws of Ukraine.
• All disputes arising in connection with these Terms shall be resolved through negotiation. If no agreement is reached, disputes shall be resolved by the court at the Service Provider's registered address.
• If any provision of these Terms is found to be invalid, this does not affect the validity of the remaining provisions.
