This is a public offer (adhesion contract) under Article 641 of the Civil Code of Ukraine. By registering on the Service and/or paying for services, you unconditionally accept all terms of this agreement. The document also contains a DPA (§ 13) — a data processing agreement covering personal data of your bot subscribers.
General provisions
- This document is an official proposal (public offer) by the Service Administration (hereinafter — "Service Provider") to enter into an agreement for access to the SaaS platform 4u.bot (hereinafter — "Service") under the terms set forth in this agreement.
- In accordance with Article 641 of the Civil Code of Ukraine, this document is a public offer. Upon acceptance of the terms below, the individual or legal entity that accepts this offer becomes the Client.
- Acceptance of the offer constitutes registration on the Service and/or payment for the Service Provider's services. Payment of the invoice also constitutes unconditional confirmation that Services for the previous period (if applicable) were rendered properly.
- The agreement is deemed concluded from the moment the Client accepts the offer.
Subject of the agreement
The Service Provider grants the Client access to the cloud SaaS platform 4u.bot for creating and managing Telegram bots (hereinafter — "Services"). The list of Service features includes:
- Visual bot builder (flow builder)
- Subscriber management and segmentation
- Mass broadcasts and message sequences
- Live chat with clients
- AI (artificial intelligence) integration
- Analytics and statistics
- Payment processing (via connected payment systems)
- Product catalog and shopping cart
- Knowledge base (RAG)
The specific scope of features is determined by the selected subscription plan.
Subscription plans and service pricing
- Current subscription plans and their pricing are published on the Subscription page.
- Service pricing is stated in Ukrainian hryvnias (UAH) and includes all applicable taxes.
- The Service Provider is a third-group single tax payer and is not a VAT payer.
- The Service Provider reserves the right to modify subscription plans and pricing. Changes take effect from the next billing period and do not affect the current paid period.
Payment procedure
Services are paid on a 100% prepayment basis for the billing period (month).
Payment methods for Ukrainian residents:
- Bank card (via monobank payment system)
- Bank transfer (non-cash payment) — for legal entities and entrepreneurs
Payment methods for non-Ukrainian residents:
- Bank card (Visa/Mastercard)
For non-cash payments, the Service Provider issues an electronic invoice. Such invoice serves as the basis for payment and a primary document confirming the provision of services. Payment deadline — 5 business days from the invoice date.
Subscription is activated upon receipt of funds in the Service Provider's account.
Confirmation of service delivery
- The parties have agreed that proper confirmation of full service delivery without claims from the Client is the Client's payment of the invoice.
- In accordance with Article 9 of the Law of Ukraine "On Accounting and Financial Reporting in Ukraine," a paid invoice is a primary document confirming the business transaction and does not require a separate bilateral act of services rendered.
- The service is deemed delivered at the moment the Client is technically provided access to the Service for the paid period.
- Upon the Client's request, the Service Provider may provide an electronic act of services rendered (with an electronic signature), if required by the Client for internal reporting.
Rights and obligations of the parties
The Service Provider undertakes to
- Provide access to the Service in accordance with the selected subscription plan
- Ensure Service operability (SLA — 99.5% monthly uptime)
- Provide technical support via built-in chat or email
- Maintain confidentiality of the Client's data
The Client undertakes to
- Pay for services in a timely manner
- Not use the Service for spam, fraud, or other illegal activities
- Comply with the Telegram Bot API terms of use
- Not share access credentials with third parties
The Service Provider has the right to
- Suspend services if the Client violates the terms of this agreement
- Make changes to the Service's functionality
- Conduct maintenance work with prior notice
Limitation of liability
The Service is provided "as is." The Service Provider does not guarantee that the Service will meet all of the Client's expectations.
The Service Provider is not liable for:
- Losses caused by actions of third parties (Telegram, payment systems, etc.)
- Data loss caused by the Client's actions
- Service unavailability due to force majeure circumstances
- Content created and distributed by the Client through the Service
The Service Provider's maximum liability is limited to the amount paid by the Client for the current billing period.
Confidentiality and personal data
- The Service Provider collects and processes the Client's personal data in accordance with applicable Ukrainian law and the Privacy Policy, which is an integral part of this Agreement.
- The Service Provider does not transfer personal data to third parties, except as required by law.
- Data of the Client's Telegram bot subscribers is stored in isolated database schemas and is accessible only to the Client.
Termination of the agreement
- The Client may cancel services at any time by cancelling the subscription in their personal account.
- Upon subscription cancellation, access to the Service is retained until the end of the paid period.
- Refunds for unused periods are not provided, in accordance with the Law of Ukraine "On Electronic Commerce" (Law 3153-IX) and Law 3321-IX.
- The Service Provider may unilaterally terminate the agreement in the event of systematic violations by the Client, with 7 days' prior notice.
Dispute resolution
- All disputes shall be resolved through negotiations. If no agreement is reached — in court at the Service Provider's location in accordance with Ukrainian law.
- This agreement is governed by and construed in accordance with the laws of Ukraine.
Amendments to the offer
- The Service Provider reserves the right to amend this offer.
- Amendments are published on this page and take effect from the publication date.
- Continued use of the Service after amendments are made constitutes the Client's agreement with the new version of the offer.

Data Processing Agreement (DPA)
- In relation to the personal data of the Client's Telegram bot subscribers, 4u.bot acts as a data processor, and the Client acts as a data controller within the meaning of the Ukrainian Law on Protection of Personal Data No. 2297-VI of June 1, 2010.
- Purpose of processing: execution of this Public Offer Agreement and operation of the Client's Telegram bots.
- Legal basis for processing: Article 11 of Ukrainian Law No. 2297-VI "On Protection of Personal Data."
- Categories of subscriber personal data processed: Telegram user ID, first name, username, messages, and bot interaction data.
- Retention period: data is retained for the duration of the agreement + 30 days after the Client deletes the bot.
Sub-processors for subscriber data:
- OpenAI, Inc. — AI services (message processing for AI responses)
- Anthropic, PBC — AI services (content generation, bot builder assistant)
- Brevo (Sendinblue) — email notifications
- monobank / LiqPay / WayForPay — subscriber payment processing
Security measures: encryption in transit (TLS), data isolation at the database schema level (schema-per-tenant), role-based access control (RBAC).
The Client is responsible for having a lawful basis for collecting and processing personal data of their bot subscribers.
